1. Scope
These Terms apply to all purchases of the digital product "FundingArb Bot" via fundingarb.net. Payment is processed by Whop (Merchant of Record).
2. Contract formation
A contract is formed upon completion of the checkout process via Whop. Upon payment, the buyer receives access to the digital files by email.
3. Delivery
Delivery is digital only — via email within 24 hours of purchase. No physical product is shipped.
4. License and usage rights
The buyer receives a non-transferable, personal license to run the software on their own hardware. The following is prohibited:
- Redistribution, resale, or sublicensing of the source code or compiled binaries
- Using the software as the basis for a competing product
- Removing copyright notices
5. Support and updates
- Starter: No support, no updates included.
- Pro: Email support for 30 days, updates for 6 months from purchase date.
- Lifetime: Priority email support for 90 days, updates guaranteed for a minimum of 2 years from purchase date, and ongoing for as long as the product is actively developed.
Definition of "Lifetime updates": The license is valid indefinitely — you may use the software permanently. Updates are guaranteed for at least 2 years from the purchase date. Beyond that, updates continue for as long as the product is actively developed. If updates are ever discontinued, Lifetime customers will receive at least 60 days' notice by email before the last update. The Lifetime plan does not constitute a perpetual support contract.
Support is provided by email. A response time of 48 hours is targeted but not guaranteed.
6. Risk disclaimer and liability
FundingArb Bot is a software tool that you operate yourself on your own infrastructure. It does not constitute investment advice, portfolio management, or any financial service. The provider does not manage assets on behalf of users and is not a regulated entity under §32 KWG or MiFID II.
Trading software involves significant financial risk. The provider accepts no liability for trading losses of any kind, lost profits, damages caused by exchange APIs, network outages, exchange malfunctions, or user misconfiguration. Past performance is not indicative of future results. Funding rates can turn negative; in extended low- or negative-rate environments, fee costs may exceed income, resulting in a net loss.
This liability exclusion does not apply to damages caused by intentional misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit) on the part of the provider, nor to damages arising from injury to life, body, or health.
7. Warranty
For consumers (B2C), the statutory warranty period of 2 years from delivery applies. For merchants (B2B), defects must be reported within 14 days of delivery by email. The provider warrants that the software is functional at the time of delivery and matches the product description on fundingarb.net.
8. Right of withdrawal
For digital products delivered immediately upon purchase, the right of withdrawal expires upon commencement of the contract, provided the buyer has explicitly agreed and acknowledged that this consent results in the loss of the right of withdrawal. See Refund Policy.
9. Governing law
German law applies. Place of jurisdiction is Aindling, Germany, insofar as the buyer is a merchant or has no general place of jurisdiction in Germany. If the buyer is a consumer within the EU, they may also bring proceedings before the courts of the country in which they are habitually resident.
10. Dispute resolution
The European Commission provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr/. The provider is not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
